These General Terms and Conditions (GTC) apply to all contracts between Zählerfreunde GmbH, Schwanthalerstraße 141, 80339 Munich, Germany (hereinafter “Zählerfreunde”) and users who use the platform under the brand “Zählerfreunde”.
White-label end customers are explicitly excluded from the scope of these GTC.
Zählerfreunde offers digital services related to the visualization, analysis and optimization of energy consumption. The services include in particular:
The specific scope of services results from the service description booked in each case.
The platform offers both free basic use and paid subscription models with extended functionality (“Premium Subscriptions”).

The service descriptions and prices displayed on the platform at the time of contract conclusion shall apply.
Subscriptions are billed monthly or annually depending on the selected plan and renew automatically unless cancelled in due time.
The contract is concluded by registering on the platform and selecting a subscription.
Contracts without a minimum term can be cancelled at any time with effect at the end of the month.
Contracts with a minimum term automatically extend for an indefinite period after the initial term and may then be cancelled on a monthly basis.
Cancellations may be submitted in text form or via the digital cancellation button in the user account.
For the “Smart Charging” module as well as for other automated optimization and control functions (e.g. load management, tariff-based optimization or AI-based control), the special terms of use for Smart Charging apply additionally.
Zählerfreunde brokers products, hardware and services from third parties.
If hardware or other products are offered via the platform or an integrated shop, separate purchase contracts are concluded exclusively between the user and the respective provider or seller.
Zählerfreunde does not become a contractual party to these purchase agreements.
Zählerfreunde shall be liable without limitation in cases of intent or gross negligence, as well as for injury to life, body or health.
In the case of slightly negligent breaches of essential contractual obligations, liability shall be limited to the typical, foreseeable damage.
The privacy policy of Zählerfreunde GmbH applies.
German law shall apply.
The place of jurisdiction is Munich, insofar as legally permissible.
